Due to allegations that Rita had an affair with a herbalist, Pastor Joshua Ajagunigbala’s marriage to Rita has been dissolved in Ekiti State.
During the hearing, he asked for both child custody and the dissolution of their marriage due to adultery. He said that they had been living together without exchanging dowries for more than 22 years.
Three times before, he had accused her of adultery in court. Mrs. Ajagunigbala claimed she had a sexual relationship with a deceased herbalist because of her husband’s neglect.
After the court ruled that the marriage was unlawful because no dowry was presented, they were free to go their own ways.
He said, “Having gone through all the oral evidence presented before this Court, it was discovered that there was no legal customary marriage between parties herein and there is no marriage available between parties to dissolve”. “The Court hereby order that the parties are now free to go on their own without disturbing the peace of each other.”

As the two youngest children of the union are still minors, the Court instructed Pastor Ajagunigbala, the petitioner, to take full responsibility for their upbringing and education.“Due to the fact that the final two children of the marriage have not yet reached the age of majority, the Court can only make custody decisions about those two children. Because they are no longer minors, the first two kids are free to choose between the two parties as to who will care for them.
“However, the Court order that the last two children of the association (Olarewaju and Victoria Ajagunigbala) are to be with the petitioner and the petitioner is to be responsible for their welfare and education,” the court stated.
